Concurrent Filing Update for EB-5 Investors

On March 15, 2022, President Biden signed a law that included authority for reauthorization of the EB-5 Immigrant Investor Regional Center Program. One of the biggest takeaways from the new law was the concept of “concurrent filing,” whereby an investor with a pending/approved I-526, who is physically present in the U.S., and who has a visa available, can concurrently file an Adjustment of Status application saving them years from waiting for a green card.

 

However, one question remained for regional center and direct investors – “when exactly could I submit my concurrent adjustment of status application?”

 

The answer? Now.

 

USCIS has updated their April 2022 Dates for Filing Visa Bulletin to indicate that regional center and direct investors from all countries (except China) are current or “C,” which means they can submit an Adjustment of Status application now.
